This Agreement governs all transactions conducted through our platform (website: ect.com.hk). By using this platform, you acknowledge having read, understood, and agreed to be bound by these terms.
1. Contract Formation and Order Validity
Customer order placement constitutes an offer. A binding contract is formed only upon our issuance of an "Order Confirmation Notice" containing an order reference number. Automated system emails shall not constitute legal acceptance.
We reserve the right to unilaterally cancel orders under following circumstances:
✓ Pricing errors or system anomalies
✓ Insufficient inventory
✓ Suspected fraud or violation of fair trade principles
2. Pricing and System Anomalies
Product pricing displaying material errors due to technical issues (including system malfunctions or human errors), such as prices below 50% of cost price, shall not constitute valid offers.
For erroneous orders caused by system anomalies, we will:
✓ Cancel order with full refund
✓ Proactively contact customer with alternative compensation (e.g., discount coupons)
Product performance data refers to manufacturer test environments. Actual performance may vary based on usage conditions.
Energy labels/certification documents may differ from displayed versions. Physical product documentation shall prevail.
3. Product Description Standards
Product images are for reference only. Actual colors/dimensions are subject to textual descriptions on product pages.
Returns for manufacturing defects require complete unboxing video evidence. Retrospective evidence submissions will not be accepted.
4. Shipping Fee Calculation
Local Orders:
✓ Free shipping for orders ≥HKD500
✓ Below threshold: Calculated by actual weight & volume (see Shipping Fee Schedule)
International Orders: Shipping fees calculated per logistics provider's quotation
5. Return/Exchange Policy
Eligible Cases:
✓ Manufacturing defects (must report within 48hrs of receipt)
✓ Incorrect items delivered
Resolution Process:
✓ Issue return authorization code & cover return shipping costs
✓ Damage from normal use: Refer to manufacturer warranty
Non-returnable Items: Opened "Hygiene-sensitive Products" (e.g., ear tips)
6. Liability Limitations
Exclusions:
✓ Order anomalies from third-party payment processor delays
✓ Delivery failures due to unupdated addresses
✓ Force Majeure events (e.g., pandemic controls, strikes)
Compensation Cap:
✓ Maximum: Actual payment amount per order
✓ Excludes indirect losses (business opportunities, moral damages, etc.)
7. Order Modification Restrictions
Modification/cancellation requests must be submitted via customer service within 2 hours of order placement.
Orders already in picking process or with overdue payments cannot be altered.
8. Intellectual Property
All website content (images, text, trademarks) constitutes our proprietary assets. Unauthorized reproduction, distribution, or commercial use is prohibited.
9. Dispute Resolution & Jurisdiction
Mandatory Mediation:
Parties must initiate formal mediation through Hong Kong Mediation Centre within 30 days of dispute occurrence.
Jurisdiction:
Unresolved mediation disputes shall be subject to exclusive jurisdiction of Hong Kong SAR courts.
Cost Allocation:
Party unreasonably refusing mediation bears opponent's legal costs.
